"Service" refers to the BotBee platform and all related features. "User" or "you" refers to the individual or business using the Service. "Content" refers to any messages, media, or data sent or received through the Service.
3. Eligibility and Account Responsibilities
You must be at least 16 years old and legally authorized to act on behalf of your business to use the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.
4. Acceptable Use Policy
You agree not to use the Service to send unsolicited or unlawful messages, distribute harmful content, violate the policies of any connected messaging platform, or engage in any activity that disrupts or harms the Service or other users.
5. Third-Party Platform and API Dependency Disclaimer
Our Service integrates with third-party platforms such as WhatsApp, Instagram, Facebook, Telegram, and others. We do not control, and cannot guarantee, the uptime, performance, message delivery, or approval processes of these third-party platforms, and we are not liable for any disruption caused by them.
6. Intellectual Property Rights
All software, design, and materials that make up the Service are owned by BotBee and protected by intellectual property laws. Nothing in these Terms grants you ownership of any part of the Service.
7. Service Availability and Modifications
We aim to keep the Service available at all times but do not guarantee uninterrupted access. We may modify, suspend, or discontinue any part of the Service at our discretion, with reasonable notice where practical.
8. Billing, Payments, and Refunds
Paid plans are billed in advance on a recurring basis unless otherwise stated. Fees are non-refundable except where required by law or explicitly stated at the time of purchase.
9. Limitation of Liability
To the maximum extent permitted by law, BotBee's total liability for any claim arising from your use of the Service is limited to the fees you paid in the six months preceding the claim.
10. Indemnification
You agree to indemnify and hold BotBee harmless from any claims, damages, or expenses arising from your misuse of the Service or violation of any third-party platform's policies.
11. Data Security
We implement reasonable technical and organizational safeguards to protect data processed through the Service, as further described in our Privacy Policy.
12. Termination of Service
We may suspend or terminate your access to the Service if you violate these Terms. You may cancel your account at any time through your dashboard or by contacting support.
13. Account Migration and Subscription Policy
If you migrate your messaging accounts or numbers to another provider, your BotBee subscription associated with that account will be terminated, and any remaining subscription value will be forfeited.
14. Linking, Branding and Framing Restrictions
You may not frame, mirror, or present the Service in a way that misrepresents its origin, nor use BotBee's name, logo, or branding without prior written permission.
15. Governing Law
These Terms are governed by the laws of India, without regard to conflict of law principles. Any disputes shall be subject to the exclusive jurisdiction of the courts located in India.
16. Policy Updates and Acceptance
We may revise these Terms periodically. Updates will be reflected by changing the effective date above, and continued use of the Service constitutes acceptance of the revised Terms.
